鉴于 Good Dog Academy Inc.(以下简称“GDA”)向客户提供国际犬只训练师基础课程(International Dog Trainer Foundations Program)的教学,以及基于其他合法且有价值的对价,GDA 与客户双方特此确认已收到并认可该等对价的充分性。客户签署本《免责、权利放弃与确认书》(以下简称“本免责书”),即表示客户确认并同意以下条款:

  1. 客户理解并同意,如客户未签署本免责书,则不得参加本课程。
  2. 客户理解,本课程仅为入门性质的信息与教育课程,旨在帮助客户了解犬只训练的基本概念,并初步了解 Good Dog Academy 的专业犬只训练师证书课程(Professional Dog Trainer Certificate Program)所涉及的内容。完成本课程并不意味着客户具备专业犬只训练师资格,不授予任何专业认证或资质,也不授权客户以专业犬只训练师或认证犬只训练师的身份对外宣传或提供服务。
  3. 客户理解并同意,本课程所教授的知识和技能仅供客户个人学习以及与自己的犬只一起使用。客户不得以本课程的全部或部分内容作为向公众提供犬只训练服务、训练客户的犬只、收取费用或接受任何形式的犬只训练报酬的依据,也不得以专业犬只训练师的身份进行广告宣传或推广。
  4. 客户理解并同意,如客户希望从事与客户及其犬只相关的工作,或提供专业犬只训练服务,应完成 Good Dog Academy 的专业犬只训练师证书课程(Professional Dog Trainer Certificate Program)或其他适当的教育及资质要求,并遵守所有适用的法律、法规或专业标准。
  5. 客户在参加本课程期间,应遵守 GDA 不时向客户提供的所有相关规则和指示。
  6. 客户在参加本课程期间,应始终以安全且尊重他人的方式行事,并充分注意自身安全、他人安全,以及所有参与本课程或受到本课程相关活动影响的犬只的安全。
  7. 客户应遵守《行为准则》(Code of Conduct)及《人道训练模式》(Humane Training Model)(其定义由 GDA 不时制定或更新)。客户进一步理解,如有任何证据证明客户实施了任何虐待动物的行为,或客户被认定未遵守《人道训练模式》,GDA 可自行决定撤销客户参加本课程的资格、客户通过本课程获得的任何证书,以及客户使用 GDA 认可标识(包括任何徽章)的权利,且不予退款。
  8. 客户理解,本课程可能涉及犬只的操作与训练,而此类活动存在固有风险。客户参加本课程可能面临身体或精神伤害的风险,包括暂时性或永久性伤害,包括但不限于不适、疼痛、痛苦、受伤、压力、毁容、肢体损伤或丧失、瘫痪和/或死亡。
  9. 客户参加本课程,即表示客户知悉并自愿接受与参加本课程相关的风险。
  10. 为降低与客观上表现出攻击性、反应性、焦虑、难以控制或过度活跃的犬只接触时所涉及的风险,客户应寻求认证行为专业人士(Certified Behaviour Professional)或兽医行为学专家(Veterinary Behaviourist)的专业意见,并应根据 GDA 的要求,向 GDA 提供相关专业转介证明以及犬只改善进展的确认资料。客户理解,本课程不能替代针对个体犬只的专业评估、行为咨询或兽医医疗服务。
  11. 客户同意,其具备参加本课程所需的身体和心理状况,并且不存在任何会限制或妨碍其参加本课程,或干扰其他人员参加本课程的身体或心理方面的问题。
  12. 客户确认,其已自行获得并满意于自身所拥有的保险保障,包括人寿保险和医疗保险。
  13. 客户理解并确认,GDA 无法且不会保证客户能够通过参加本课程建立盈利业务、获得就业机会或取得任何特定成果。
  14. 客户理解并同意,本课程中包含的任何知识产权内容仅供客户个人使用。除非获得 GDA 的明确书面授权,否则客户无权复制、分享、翻印、重新发布、上传、下载、发布、传输或以其他方式复制全部或部分课程材料。
  15. 客户理解并同意,除非获得 GDA 的明确书面授权,否则客户并未获得任何明示或默示的许可,不得出于任何目的链接至或以框架形式展示课程材料、GDA 网站或其任何部分。
  16. 客户理解并同意,为方便客户,本课程可能会提供或引用第三方网站。由于 GDA 无法控制此类第三方网站,因此 GDA 无法保证、声明或担保此类第三方网站所包含的内容准确、合法和/或不存在冒犯性内容。
  17. 客户理解并确认,GDA 无法保证其网站、课程及相关教学内容始终不存在错误或中断,也无法保证用于提供课程及教学内容的软件不存在病毒或其他有害组件。
  18. 客户理解并确认,本课程可能会因例行维护而不时暂时无法使用。
  19. 客户特此解除并永久免除 GDA 及其各自的关联公司、子公司、保险公司、代表、股东、董事、高级管理人员、员工、工作人员、代理人、继承人、遗产管理人、承继人及受让人(以下统称“GDA 被免责方”)因客户参加本课程而产生或与之相关的任何及所有诉讼、法律程序、损害赔偿、索赔、要求、成本、费用、判决及任何性质且无论以何种方式产生的责任,无论该等事项目前是否已知,也无论依据法律或衡平法产生,包括因客户参加本课程而导致或与之相关的任何伤害、死亡或经济损失,即使该等损失、损害、伤害或死亡可能由客户以外的其他人员或他人的犬只造成。
  20. 对于上一条款中已被解除或免除的任何事项,如有关索赔或法律程序可能导致任何 GDA 被免责方面临分担责任、赔偿责任或其他救济要求,客户不得针对任何个人或实体提出任何索赔或提起任何法律程序。
  21. 客户理解,签署本免责书后,客户将不得就因参加本课程而产生的事项对任何 GDA 被免责方提起诉讼或提出任何索赔。
  22. 客户确认,本免责书不得被解释为 GDA 对任何责任的承认。
  23. 如因客户违反其在本免责书中作出的任何承诺或陈述,而直接或间接导致 GDA 被免责方遭受任何损失、损害、责任、成本或费用,客户应对 GDA 被免责方作出赔偿,并确保其免受相关损失或责任。
  24. 客户确认,其参加本课程完全出于自由及自愿。
  25. 客户确认,其已年满 19 周岁。
  26. 客户声明,其已阅读并理解本免责书,并在签署本免责书及参加本课程之前,有机会审阅本免责书,并已就其希望了解的任何事项向 GDA 进行询问。
  27. 本免责书应使 GDA 被免责方的继承人、遗嘱执行人、遗产管理人、承继人及受让人受益,并对其具有约束力;同时,本免责书亦对客户的继承人、遗嘱执行人、遗产管理人、承继人及受让人具有约束力。
  28. 本免责书应受加拿大不列颠哥伦比亚省法律管辖,并依据该省法律进行解释和执行。
  29. 客户可采用亲笔签名或数字签名的方式签署本免责书,并可通过当面递交、传真或其他电子传输方式交付。任何经数字签名的副本、传真副本或通过电子邮件发送的 PDF 副本,均应视为原始文件,并对客户具有约束力。

客户已于下方所填写日期正式签署本《免责、权利放弃与确认书》,以昭信守。

Waiver, Release & Acknowledgement

In consideration of Good Dog Academy Inc. (“GDA”) providing the Customer with instruction in the International Dog Trainer Foundations - CN Program and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by both GDA and the Customer, with signing this Waiver, Release and Acknowledgment (the “Waiver”) the Customer hereby acknowledges and agrees as follows:

  1. The Customer understands and agrees that the Customer would not be permitted to participate in the Program if the Customer did not sign this Waiver.
  2. The Customer understands that the Program is an introductory, informational course only. It is designed to provide education about dog training concepts and to give the Customer a sense of what Good Dog Academy’s Professional Dog Trainer Certificate Program involves. Completion of this Program does not qualify the Customer as a professional dog trainer, does not confer any certification or credential, and does not authorize the Customer to represent themselves as a Professional or Certified Dog Trainer.
  3. The Customer understands and agrees that the knowledge and skills taught in the Program are for the Customer’s personal use with their own dog(s) only. The Customer shall not use the Program, in whole or in part, as the basis for offering dog training services to the public, working with clients’ dogs, charging money or accepting any form of compensation for dog training, or advertising or promoting themselves as a Professional Dog Trainer.
  4. The Customer understands and agrees that if the Customer wishes to pursue work with clients or to offer professional dog training services, the Customer should complete Good Dog Academy’s Professional Dog Trainer Certificate Program or other appropriate education and credentials, and comply with any applicable laws, regulations, or professional standards.
  5. The Customer shall follow all rules and directions that GDA provides to the Customer from time to time regarding the Customer’s participation in the Program.
  6. The Customer shall conduct the Customer’s self in a safe and respectful manner during the Customer’s participation in the Program, having attention to both the Customer’s own safety and the safety of others and the safety of all dogs participating in or affected by the Program.
  7. The Customer shall adhere to the Code of Conduct and the Humane Training Model (as defined from time to time by GDA) and the Customer further understands that their participation in the Program and any certificate the Customer earns with this Program and any use of GDA endorsement (including any badge) may be revoked by GDA in its sole discretion, without refund, should there be any proof of any animal cruelty committed by the Customer or should the Customer be found to not follow the Humane Training Model.
  8. The Customer understands that the Program may involve the handling and training of dogs and that this involves inherent risks and that in participating in the Program, the Customer is at risk of physical and mental injuries, temporary and permanent, including but not limited to discomfort, pain, suffering, injury, stress, disfigurement, dismemberment, paralysis and/or death.
  9. The Customer is accepting of the risks involved by participating in the Program.
  10. The Customer, to mitigate risks when dealing with a dog that is objectively aggressive, reactive, anxious, unruly or hyperactive, shall seek the advice of a Certified Behaviour professional or Veterinary Behaviourist and shall provide to GDA, as GDA requests, proof of such professional referral and confirmation of progress made. The Customer understands that the Program is not a substitute for individual professional assessment, behaviour consultation, or veterinary care.
  11. The Customer agrees that the Customer has the necessary physical and mental fitness to participate in the Program and that the Customer does not have any physical or mental issues that would limit or prevent the Customer from participating in the Program or interfere with others participating in the Program.
  12. The Customer is satisfied that the Customer has its own insurance coverage, including life and medical.
  13. The Customer understands and acknowledges that GDA cannot and will not guarantee that the Customer will develop a profitable business, obtain employment or achieve any particular outcome from the Customer’s participation in the Program.
  14. The Customer understands and agrees that any intellectual property contained in the Program is provided for the Customer’s own personal use only and the Customer does not have any rights to copy, share, reproduce, republish, upload, download, post, transmit or duplicate the materials in whole or part, unless specifically authorized in writing by GDA.
  15. The Customer understands and agrees that the Customer has no license, express or implied, to link to or frame the materials, GDA’s website, or any portion thereof, for any purpose unless specifically authorized in writing by GDA.
  16. The Customer understands and agrees that for the Customer’s convenience the Program may reference third-party websites that GDA has no control over and therefore GDA cannot guarantee, represent or warrant that the content contained on such Third-Party Sites as being accurate, legal, and/or inoffensive.
  17. The Customer understands and acknowledges that GDA cannot guarantee that its website, programs and courses will be error-free or uninterrupted or the software used to deliver the programs and courses will be free of viruses or other harmful components.
  18. The Customer understands and acknowledges that the Program may, from time to time, be unavailable due to routine maintenance.
  19. The Customer HEREBY RELEASES AND FOREVER DISCHARGES GDA and its respective affiliates, subsidiaries, insurers, representatives, shareholders, directors, officers, employees, servants, agents, heirs, administrators, successors, and assigns (collectively, hereinafter the “GDA Releasees”) of and from any and all manner of suits, proceedings, damages, claims, demands, costs, expenses, judgments, and liabilities of whatsoever kind and howsoever arising, known or unknown, whether at law or in equity which the Customer now has or hereafter shall or may have for or by reason of any matter arising out of the Customer’s participation in the Program, including for or by reason of any injury or death or financial loss to the Customer, and notwithstanding that such loss, damage, injury or death may have been caused by someone other than the Customer or someone else’s dog.
  20. The Customer shall not make any claim or take any proceedings against any person or entity with respect to any matter released or discharged in the previous section which may result in any claim arising against the GDA Releasees for contribution or indemnity or other relief.
  21. The Customer understands that by signing this Waiver that the Customer will be prevented from suing or making any claim against the GDA Releasees arising out of the Customer’s participation in the Program.
  22. The Customer acknowledges that this Waiver shall not be interpreted as any admission of liability by GDA.
  23. The Customer shall indemnify and save harmless the GDA Releasees from any loss, damage, liability, cost and expense suffered by the GDA Releasees directly or indirectly as a result of or arising out of the Customer’s breach of the Customer’s promises and representations in this Waiver. 
  24. The Customer confirms that the Customer is participating in the Program freely and voluntarily.
  25. The Customer confirms that the Customer is at least 19 years of age.
  26. The Customer represents that it has read and understood this Waiver and has had the opportunity to review this Waiver and has made any desired inquiries to GDA before signing it and participating in the Program.
  27. This Waiver shall endure to the benefit of and be binding upon the GDA Releasees’ heirs, executors, administrators, successors, and assigns and shall be binding upon the Customer’s heirs, executors, administrators, successors, and assigns.
  28. This Waiver shall be governed by and construed and enforced in accordance with the laws of the Province of British Columbia.
  29. This Waiver may be signed by the Customer with a wet-ink or digital signature and delivered in person, by facsimile or other electronic transmission, and each such digitally signed, facsimile or .pdf email electronic transmission copy shall constitute an original document and be binding upon the Customer.

The Customer has signed this Waiver, Release and Acknowledgment under seal as of the date written below.
